The Infrastructure & Jobs Development Council (IJDC) was created by the West Virginia Legislature in 1994 as a governmental instrumentality of the state. The Infrastructure and Jobs Development Act (the Act) (WV Code §31-15A) was approved by the voters and authorized a $300 million General Obligation Bond Issue to establish a revolving loan fund for development of water, wastewater and economic development projects. The Act further authorizes the Council to issue revenue bonds. In 2001 the West Virginia Legislature authorized the IJDC to receive up to $40 million annually through the State Excess Lottery Revenue fund (WV Code §29-22-18a). The Act establishes the Infrastructure Fund and the distribution dollars in the fund.
WV Code §31-15A-5a requires that No project sponsor may apply for or receive any loan, loan guarantee, grant or other funding assistance for a project or infrastructure project from any state infrastructure agency (i) unless the project sponsor requiring the funding assistance first submits a completed preliminary application to the council… Therefore, any utility wishing to obtain funds from any state agency must first submit a preliminary application for review by the IJDC. WV Code 31-15A-3b states: The council shall consist of thirteen members, including the Governor or designee, the Executive Director of the Housing Development Fund or his or her designee, the director of the Division of Environmental Protection or his or her designee, the director of the Economic Development Authority or his or her designee, the Director of the Water Development Authority or his or her designee, the Director of the Division of Health or his or her designee, the chairman of the Public Service Commission or his or her designee, and four members representing the general public: Provided, That there shall be at least one member representing the general public from each congressional district: Provided, however, That after the expiration of the term of office of the members first appointed as representatives of the general public, no more than one member representing the general public may be a resident of the same county. The Governor shall appoint the public members of the Council who shall serve three-year staggered terms. The Commissioner of the Division of Highways, the Executive Director of the state rail authority, two members of the West Virginia Senate, two members of the West Virginia House of Delegates, the chancellor of the higher education policy commission and the chancellor of the West Virginia council for community and technical college education serve as advisory members of the council. The Governor shall appoint the legislative members of the council: Provided further, That no more than three of the legislative members may be of the same political party. The Governor shall appoint the representatives of the governing boards from a list of three names submitted by each governing board.
